Terms of Use & EULA

These Terms of Use and End User License Agreement ("Terms" or "EULA") are a legal agreement between you and HabbitHub Developers ("we", "our" or "us") governing your use of our mobile applications (each, "the App"). By downloading, installing or using the App you agree to these Terms; if you do not agree, do not use the App. This agreement is between you and HabbitHub Developers only, not with Apple, and Apple is not responsible for the App or its content.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. Except as permitted by those rules or applicable law, you may not copy, decompile, reverse engineer, disassemble, modify, rent, lease, lend, sell, redistribute or create derivative works of the App.

Your license to use the App is also governed by Apple's standard Licensed Application End User License Agreement ("Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. These Terms supplement the Apple Standard EULA. In the event of any conflict between these Terms and the Apple Standard EULA regarding your license to use the App, the Apple Standard EULA governs to the extent of that conflict.

2. Subscriptions & purchases

• Payment is charged to your Apple ID at confirmation of purchase.
• Auto-renewable subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel subscriptions anytime in your Apple ID account settings.
• Where a free trial is offered, any unused portion is forfeited when you buy a subscription.
• Refunds are handled by Apple under Apple's policies; we cannot process refunds directly.

3. Maintenance & support

We are solely responsible for providing any maintenance and support for the App, as required by law. Apple has no obligation to furnish any maintenance or support. For support, email contact@habbithubdevelopers.com.

4. Warranty

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranty of any kind. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.

5. Product claims

We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including product liability claims, any claim that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

6. Intellectual property

The App and its content are owned by us or our licensors and protected by intellectual property laws. If a third party claims that the App infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.

7. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-party terms

You must comply with applicable third-party terms (for example, your wireless data plan) when using the App. The App uses third-party services including Google AdMob, RevenueCat, Firebase and AppsFlyer, whose terms and privacy policies also apply — see our Privacy Policy.

9. Apple as a third-party beneficiary

You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Acceptable use

You agree to use the App only for lawful purposes, and not to misuse it, interfere with its operation, or attempt to access it in an unauthorized way.

Limitation of liability

To the maximum extent permitted by law, we and our suppliers are not liable for any indirect, incidental, special or consequential damages, or any loss of data or profits, arising out of or related to your use of or inability to use the App.

Termination

This license is effective until terminated. Your rights end automatically if you fail to comply with these Terms. On termination you must stop using the App and delete it.

Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where your local consumer law requires otherwise.

Changes

We may update these Terms from time to time. Continued use of the App after changes are posted means you accept the updated Terms.
